A meeting regarding Justice and Home Affairs took place on 2nd June 2016 between the representatives of the United States and the European Union. In said meeting, the transfer of personal data by law-enforcement authorities between the United States and the member countries of the European Union was dealt with, among other issues.
To this effect, the United States and the European Union signed a framework agreement to regulate personal data traffic under law, and which forms part of the normalisation plan for the transfer of personal data between European Union countries and the United States.
This, together with the EU-US Privacy Shield, mentioned in a previous post, the idea is to regulated the transfer of personal data, creating a security framework for the collaboration between the administration and private entities.
Said regulation arises from the Judgement of the High Court of Justice of the European Unión of 6th October 2015, also mentioned in a previous article, which annulled the decision of the European Commission which declared the USA a “safe harbour” (“puerto seguro”) regarding the protection of data.
Is should be noted that this agreement is still to be ratified by the European Parliament and as yet there is no date set for said ratification.
