ORDER 1882/2012 of 1st August 2012 approves the new General Conditions of Contract for the carriage of goods by road.
The introductory notes of the order disclose that the Spanish Transport Contract Act 15/2009 has notably influenced the contents of said General Conditions.
The legislator favoured the reproduction of a considerable part of the precepts of the mentioned Contract Act. The following innovations may be highlighted:
1. A formula for price revision taking into account fuel price variation is included.
2. Certain timetables and deadlines for the fulfilment of the reciprocal obligations have been established.
3. If the buyer does not fulfil its obligation, the carrier will be able to retain the goods and apply to the competent Court for the storage of the said goods.
4. The invoice maturity date established is 30 days and any longer term will be considered as null.
This Ministerial Order came into force on the 21st August 2012.
