On 17th March Order ECD/576/2012 entered into force, establishing public prices for mediation and arbitration procedures in the First Section of the Intellectual Property Committee.

Said payments are divided into two parts: a payment prior to the filing of the procedure application and a later payment upon the termination thereof. The prices vary depending on the procedure.

The price fixed for the first payment is 1.416 Euro for mediation and 1.716 Euro for arbitration. Said payment shall cover costs for granting the application as well as the amount corresponding to a procedural session, whether mediation or arbitration, according to what has been applied for.

The payment should be effected in cash, at any authorised entity. Once payment has been made, proof thereof shall be attached to the application for mediation or arbitration. If the application is granted, the amounts already paid would be returned, except where the cause for not granting the application were attributable to the applicant.

The second payment shall be composed of the expenses generated in the procedure by the number of sessions required and the evidence proposed by the parties. The Order fixes the following prices:

  • 1.316 Euro for mediation (maximum of 5 sessions)
  • 1.616 Euro for arbitration (maximum of 5 sessions)

Likewise, the taking of evidence must be paid for separately, always by the applicant party, although the price has not been fixed by the Order in this respect.

Said payments must be effected within two months as from the notification of the termination of the mediation or arbitration procedure. The collection through an enforcement procedure shall be the competence of the Spanish Tax Administration (Agencia Estatal de Administración Tributaria).
