{"id":1872,"date":"2016-02-19T12:23:15","date_gmt":"2016-02-19T12:23:15","guid":{"rendered":"https:\/\/vila.es\/en\/?p=1872"},"modified":"2021-02-11T11:51:38","modified_gmt":"2021-02-11T11:51:38","slug":"recovery-safe-harbour-unted-states","status":"publish","type":"post","link":"https:\/\/vila.es\/en\/european-union\/recovery-safe-harbour-unted-states\/","title":{"rendered":"RECOVERY OF THE \u201cSAFE HARBOUR\u201d IN THE UNTED STATES"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>NEW FRAMEWORK<\/strong><\/p>\n<p style=\"text-align: justify;\">On 2 February 2016, the European Commission issued a press release announcing that they had reached a <strong>consensus with the US Government in order to establish a new framework for personal data exchange<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Said new framework has been named \u201cEU-US Privacy Shield\u201d and, according to said press release, it aims to meet the requirements mentioned in the judgement of the European Court of Justice on 6 October 2015, already commented in a previous article and which annulled the Commission\u2019s decision that declared the US as \u201csafe harbour\u201d with regard to data protection.<\/p>\n<p style=\"text-align: justify;\">However, such negotiation <strong>has not yet materialised in any binding decision <\/strong>for operators.<\/p>\n<p style=\"text-align: justify;\"><strong>PRACTICAL EFFECTS<\/strong><\/p>\n<p style=\"text-align: justify;\">After the US \u201csafe harbour\u201d was cancelled, until a new binding decision is made by the European Commission, companies wishing to transfer personal data to the US must <strong>apply for a regulatory approval from the Spanish Data Protection Agency<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Companies applying for said approval must provide, among others:<\/p>\n<p style=\"text-align: justify;\">the <strong>contract<\/strong> based on the standard contractual clauses from which the transfer is derived; an <strong>application letter<\/strong>; <strong>powers of attorney<\/strong> of the applicant; etc.<\/p>\n<p style=\"text-align: justify;\">For the transfer between <strong>companies belonging to the same group<\/strong>, the Binding Corporate Rules (BCR) are to be observed.<\/p>\n<p style=\"text-align: justify;\">Once all documents have been submitted, the AEPD (the Spanish Data Protection Agency) is allowed a period of <strong>three months to rule a decision<\/strong> (positive or negative). Once this period of three months has elapsed, the authorisation will be considered to have been granted.<\/p>\n<p style=\"text-align: justify;\"><strong>CONCLUSION<\/strong><\/p>\n<p style=\"text-align: justify;\">Said procedure will vanish for transfers of data to the United State if the U.S is declared a safe harbour again. According to the press release of 2 February, the Commission will issue the corresponding decision as soon as U.S. authorities carry out modifications in their regulation.
