{"id":1805,"date":"2015-10-23T12:53:55","date_gmt":"2015-10-23T12:53:55","guid":{"rendered":"https:\/\/vila.es\/en\/?p=1805"},"modified":"2021-02-15T12:12:36","modified_gmt":"2021-02-15T12:12:36","slug":"freelancers-limited-liability","status":"publish","type":"post","link":"https:\/\/vila.es\/en\/corporate\/freelancers-limited-liability\/","title":{"rendered":"FREELANCERS AND LIMITED LIABILITY"},"content":{"rendered":"<p style=\"text-align: justify;\">Since the entering into force of the <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"http:\/\/www.labourlawnetwork.eu\/national_labour_law\/national_legislation\/legislative_developments\/prm\/109\/v__detail\/id__3587\/category__2\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">Act 14\/2013<\/a><\/span>, of 27th of September, to support entrepreneurs, individuals can directly and partially limit their responsibilities for the business or professional debts that they may incur as a result of their activities.<\/p>\n<p style=\"text-align: justify;\">Such limitation of liability is constrained exclusively to the regular residence of the entrepreneur in a way that are creditors of said person may not be able to request a seizure on the residence in order to confront the debts that the entrepreneur may have incurred.<\/p>\n<p style=\"text-align: justify;\">The requirements to be met by the entrepreneur\u2019s regular residence so that it is extent from the debtor\u2019s pecuniary responsibility are as follow:<\/p>\n<ul>\n<li style=\"text-align: justify;\">The value of the main residence shall not exceed the amount of 300,000\u20ac or 450,000\u20ac\u00a0if it is located in a town where the population exceeds 1 million people.<\/li>\n<li style=\"text-align: justify;\">The debts incurred must arise from the exercise of the business or professional activity of the entrepreneur, meaning private or family debts are excluded from the exemption.<\/li>\n<li style=\"text-align: justify;\">The acts of the entrepreneur do not constitute serious fraud or negligence in compliance with his obligations with third parties.<\/li>\n<li style=\"text-align: justify;\">The condition of \u201cfreelancer with limited liability\u201d is registered with the corresponding Mercantile Register.<\/li>\n<li style=\"text-align: justify;\">\u00a0The condition of \u201cFreelancer with limited liability\u201d is stated in any documentation.<\/li>\n<li style=\"text-align: justify;\">The exemption of the residence from confronting the future debts generated by the activity of the entrepreneur is registered in the Property Register.<\/li>\n<li style=\"text-align: justify;\">The entrepreneur formulates and deposits in the Mercantile Register the annual accounts relevant to the entrepreneurial or professional activity, in accordance with the provisions for companies with limited liability.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The limitation of liability will have no effect on those debts that were already incurred at the moment of establishing the condition of \u201cFreelancer of Limited Liability\u201d.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>Vil\u00e1 Abogados<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">For more information, please contact<\/p>\n<p><a href=\"mailto:va@vila.es\"><span style=\"color: #3366ff;\">va@vila.es<\/span><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>23<sup>rd<\/sup> October 2015<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Since the entering into force of the Act 14\/2013, of 27th of September, to support entrepreneurs, individuals can directly and partially limit their responsibilities for the business or professional debts that they may incur as a result of their activities.
