Spain in particular \u2013 currently the fastest growing economy in the Eurozone<a href=\"applewebdata:\/\/92980DA0-5B79-48F1-9B60-68CD5050440C#_ftn2\" name=\"_ftnref2\"><\/a> \u2013 remains a significant trading partner for the UK, with recent statistics showing an increase in bilateral trade in goods and services between the two countries of 9.4 per cent.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Following the Brexit referendum, years of negotiations were to follow, as successive governments in Westminster sought to seal a deal with Brussels before the UK\u2019s departure on the 31<sup>st<\/sup> January 2020. The principal outcome of these discussions was the EU-UK Trade and Cooperation Agreement (hereinafter, the \u201c<strong>TCA<\/strong>\u201d), which entered into force on the 1<sup>st<\/sup> May 2021 and governs post-Brexit EU-UK relations. Against this backdrop of continued economic interdependence, the upcoming review of the TCA should carry considerable commercial significance.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">The TCA must be reviewed five years after its entry in force and every five years thereafter, pursuant to Article 776. This is primarily a review of its implementation rather than a review of the deal itself, though there are other review clauses in the TCA which allow for more targeted negotiation at the request of either the UK or the EU. This flexibility therefore suggests that the outcome of such review is heavily dependent on political will and approach. It could, for example, be a narrower, more technical review of the functioning of the deal five years on, or instead, a broader platform for more supplementary agreements or adjustments to allow for further cooperation and a closer relationship between the UK and the EU.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Although the 2026 review formally covers the implementation of the deal as a whole, the TCA also identifies specific areas to be examined within this broader process. The first area, and perhaps the most relevant for cross-border business, is the joint review of legal framework in relation to trade in services and investment, with the aim of considering improvements to the provisions on trade in services and investment (Article 126). This will include the review of non-conforming measures set out in the TCA, though it expressly excludes the review of financial services. The other area that is expressly mentioned as part of the general review covers law enforcement and judicial cooperation more broadly, including the sharing of passenger data in relation to air travel, as well as surrender and extradition mechanisms.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Additionally, Article 411 stipulates that a separate review of broader trade provisions could take place from 2025 onwards at the request of either the UK or EU. It provides more details on the scope of a trade review and how it may lead to discussion of proposed amendments to the TCA, potentially covering aviation, road transport, social security coordination and visas for short-term visits, and fisheries.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">The general review coincides with the end of the transitional period for energy cooperation and fisheries, with the latter being a particularly contentious point of discussion during negotiations to reach a Brexit deal. The mutual desire for enhanced cooperation was reinforced last year when the EU-UK summit adopted a Joint Statement reaffirming both parties\u2019 commitment to the implementation of the Withdrawal Agreement and the TCA, ensuring that future opportunities for cooperation are maximised. The summit reached a \u201cCommon Understanding\u201d, encompassing strengthened cooperation in fisheries and energy arrangements without the need for further deals and under the TCA. The EU and the UK reached an agreement to extend the fisheries deal following the summit for a further 12 years and extends EU access to UK waters. In relation to energy, both parties agreed last year to start negotiations on British participation in the EU\u2019s internal electricity market supposedly on the condition that the UK contributes cohesion funding to the bloc, mirroring Norway, which is not a member state but has paid access to the internal energy market. With the volatility of energy talks, whereby the EU and UK both face their second energy crisis in just five years, it seems sensible that both parties would lean towards more integration and, consequently, more stability. This would fit in with the broader pattern in the last few months of the UK seeking closer ties with the EU in light of the war in Iran and the calling-into-question of its special relationship with the US, meaning that the TCA review may best be anticipated through the lens of prioritising economic security and close collaboration, complementing the parallel agreements that have already been put in place prior to such review.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">As a whole, short-term change as a result of the review is unlikely, as its scope covers the implementation of the TCA rather than any amendment per se. However, meaningful change may arise from new sector-specific arrangements, meaning that businesses with interests in the UK and the EU should actively monitor implementation discussions, and in particular, new agreements linked to the reset.
