{"id":1407,"date":"2013-04-11T10:46:51","date_gmt":"2013-04-11T10:46:51","guid":{"rendered":"https:\/\/vila.es\/en\/?p=1407"},"modified":"2022-05-24T14:41:46","modified_gmt":"2022-05-24T14:41:46","slug":"individual-objections-to-the-collective-dismissal-procedures-carried-out-during-insolvency-proceedings","status":"publish","type":"post","link":"https:\/\/vila.es\/en\/bankruptcy\/individual-objections-to-the-collective-dismissal-procedures-carried-out-during-insolvency-proceedings\/","title":{"rendered":"INDIVIDUAL OBJECTIONS TO THE COLLECTIVE DISMISSAL PROCEDURES CARRIED OUT DURING INSOLVENCY PROCEEDINGS"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong><span style=\"font-weight: color: #555555;\">INTRODUCTION<\/span><\/strong><br style=\"font-weight: color: #555555;\" \/><br style=\"font-weight: color: #555555;\" \/><span style=\"font-weight: color: #555555;\">During the insolvency proceedings of the company GRUPO DUHL, S.L. the competent Commercial Court issued an order passing the collective dismissal of the employees of said company.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: color: #555555;\">The employees formulated an appeal objecting to the aforementioned court order in the face of the decision of the Commercial Court.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: color: #555555;\">In their appeal, the employees argued, amongst other things, that an infringement of the effective protection of the court had taken place, derived from the lack of proper defence. The employees deemed that such lack of proper defence existed because of the pending judicial decision between the issue of the court order and the proceedings against the collective dismissal, initiated by each one of the employees before the Labour Courts.<\/span><br style=\"font-weight: color: #555555;\" \/><br style=\"font-weight: color: #555555;\" \/><strong><span style=\"font-weight: color: #555555;\">COURT DECISION<\/span><\/strong><br style=\"font-weight: color: #555555;\" \/><br style=\"font-weight: color: #555555;\" \/><span style=\"font-weight: color: #555555;\">In accordance with the High Court of Justice of Andaluc\u00eda, article 64 of the Insolvency Act establishes a channel for individual objections to collective employment dismissal; it being necessary for such objections to be conducted in the insolvency proceedings.
