{"id":1403,"date":"2013-04-03T10:44:20","date_gmt":"2013-04-03T10:44:20","guid":{"rendered":"https:\/\/vila.es\/en\/?p=1403"},"modified":"2022-05-24T15:15:12","modified_gmt":"2022-05-24T15:15:12","slug":"comments-on-the-draft-bill-for-the-modification-of-the-intellectual-property-act-and-spanish-civil-procedure-act","status":"publish","type":"post","link":"https:\/\/vila.es\/en\/litigation-and-arbitration\/comments-on-the-draft-bill-for-the-modification-of-the-intellectual-property-act-and-spanish-civil-procedure-act\/","title":{"rendered":"COMMENTS ON THE DRAFT BILL FOR THE MODIFICATION OF THE INTELLECTUAL PROPERTY ACT AND SPANISH CIVIL PROCEDURE ACT"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>I.- INTRODUCTION.<\/strong><\/p>\n<p style=\"text-align: justify;\">On Friday 22<sup>nd<\/sup>\u00a0March 2013 the Cabinet of Spain passed the\u00a0<span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"http:\/\/www.mecd.gob.es\/servicios-al-ciudadano-mecd\/dms\/mecd\/servicios-al-ciudadano-mecd\/participacion-publica\/propiedad-intelectual\/propiedad-intelectual-anteproyecto-ley.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Draft Bill for the modification of the Intellectual Property Act and Spanish Civil Procedure Act<\/a>.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>II.-\u00a0 PRINCIPAL MODIFICATIONS.<\/strong><\/p>\n<p style=\"text-align: justify;\">The main measures intended to be introduced by said draft bill may be divided into four blocks:<\/p>\n<p style=\"text-align: justify;\">a)\u00a0\u00a0\u00a0\u00a0\u00a0Implementation of\u00a0<span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"http:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=OJ:L:2011:265:0001:0005:EN:PDF\" target=\"_blank\" rel=\"noopener noreferrer\">EU Directive<\/a><a style=\"color: #3366ff;\" href=\"http:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=OJ:L:2011:265:0001:0005:EN:PDF\" target=\"_blank\" rel=\"noopener noreferrer\"><em>\u00a02011\/77\/UE<\/em><\/a>\u00a0<\/span>in Spanish legislation, by virtue of which the term of protection of the rights of artists or performers and the producers of phonograms shall be extended from 50 to 70 years.<\/p>\n<p style=\"text-align: justify;\">b)\u00a0\u00a0\u00a0\u00a0\u00a0Restriction of the legal concept of \u201cprivate copy\u201d, which shall be limited to reproductions carried out by individuals for their private use from an original (CD, DVD,\u2026) acquired via commercial sale.<\/p>\n<p style=\"text-align: justify;\">c)\u00a0\u00a0\u00a0\u00a0\u00a0Design of new supervision mechanisms of the intellectual property rights collective management organisations:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Possibility of removing government organs and of temporary intervention in collective management organisations who default on their legal obligations.<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Precision and hardening of the distribution, prescription and payment conditions of the rights collected by the collective management organisations.<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Enlargement of the catalogue of obligations of the collective management organisations, and establishment of infringements and sanctions which allow administrative responsibilities to be demanded from them for default on their legal obligations.<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Reinforcement of the functions of the First Section of the Intellectual Property Commission, granting it competence for regulatory actions and establishing tariffs.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">d)\u00a0\u00a0\u00a0\u00a0\u00a0Improvement in the protection of intellectual property rights in the Internet:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Extension of the faculties of the Second Section of the Intellectual Property Commission:<\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ol style=\"font-weight: color: #555555;\">\n<li>Included in its sphere of action are websites whose principal activity is to offer links to contents which are \u201cnotoriously offered illicitly\u201d. Search engines such as Google are excluded.<\/li>\n<li>Creation of a notice board for electronic edicts, which shall have full effects globally for the purposes of notification.<\/li>\n<li>Faculty for imposing economic sanctions of between<strong>\u00a0<\/strong>30.000 y 300.000 Euro in the case of repeated breach of the requirements to withdraw illicit content from websites.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li>Modification of the Spanish Civil Procedure Act in order to be able to, as preliminary proceedings before filing a lawsuit, apply for the identification details of a website allegedly infringing intellectual or industrial property rights.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>III.- CONCLUSION.<\/strong><\/p>\n<p style=\"text-align: justify;\">The draft bill shall now start the advisory phase before initiating parliamentary processing.
